Welcome to Kindra Knight Parker Studio ("KKP," "I," "me," or "my"). This website is owned and run by Kindra Knight Parker. Kindra Knight Parker Studio is a sole proprietorship operating under a registered trade name, based in Hoover, Alabama, USA.

These Terms explain the rules for using my website and buying my art. By using this site or placing an order, you agree to these Terms. Please read them. If you don't agree, please don't use the site or place an order.

My store runs on Shopify. Shopify's own terms also apply to how the platform works. These Terms cover your relationship with me.

2. Who can buy

You must be at least 18 years old, or have a parent or guardian's permission, to place an order. You agree that the information you give me (name, address, payment details) is true and complete.

3. My artwork

  • Originals are one of a kind. Each original painting is handmade by me. Brushstrokes, texture, and small marks are part of the art. They are not flaws.
  • Colors may look different on screens. I photograph my work carefully. But every screen shows color a little differently. Small differences in color or texture are not a defect.
  • Sizes are listed as accurately as I can. Small differences (up to about 1/4 inch) can happen with handmade work.
  • Prints are reproductions. Prints are made from my original paintings. They are not originals. They are printed to order by my print partner, LumaPrints.

4. Prices, payment, and availability

  • All prices are in U.S. dollars.
  • Sales tax is added at checkout where required.
  • Payment is due in full when you order, unless it's a commission. Commissions follow the Commission Terms.
  • Because originals are one of a kind, an item can sell out before your order goes through. If that happens, I'll let you know and give you a full refund.
  • If a price or description is listed by mistake, I may cancel the order and give a full refund. I'll always let you know first.
  • I may change prices, products, or these Terms at any time. Changes don't affect orders already placed.

5. Final sales and refunds

Original paintings and commissions are final sale. The only exception is damage during shipping. Details are in my Refund & Return Policy.

6. Copyright: buying art is not buying the copyright

When you buy a painting or print, you own that physical object. You do not own the copyright. I keep all copyrights in my paintings, images, designs, and poems.

This means you may not copy, print, reproduce, sell, or license images of my work. You may not use my work to train artificial intelligence (AI) tools. You may not use my work for any commercial purpose without a written license from me.

You can display, enjoy, sell, or give away the physical painting you bought. Full details are in my Copyright & Image Use notice.

7. Using this website

Please don't:

  • Copy, download, or scrape images or text from this site (except as allowed in my Copyright & Image Use notice).
  • Use bots, scrapers, or automated tools on this site, including for AI training or data collection.
  • Try to hack, overload, or interfere with the site.
  • Use the site for anything illegal or harmful.

8. Messages and submissions

When you contact me or submit a form, please be kind and honest. If you send me ideas, photos, or reference images (for example, for a commission), you confirm you have the right to share them. Commission reference images are covered in my Commission Terms.

9. Disputes and chargebacks

If something is wrong with your order, please contact me first at kindra@kindraknightparkerstudio.com. Most problems can be fixed quickly and kindly.

If a chargeback or payment dispute is filed, I may share order details with the payment company. This can include your order record, these policies, product photos, messages between us, and shipping and delivery tracking. A chargeback that ends with the funds returned to me does not cancel your order or these Terms.

10. Limits of liability

I work hard to keep this site accurate and running. But the site is provided "as is." I can't promise it will always be error-free or available.

To the fullest extent the law allows, KKP is not responsible for indirect or consequential losses from using this site or my products. My total responsibility for any claim about an order is limited to the amount you paid for that order.

Nothing in these Terms limits rights you have under the law that can't be waived.

11. Governing law

These Terms are governed by the laws of the State of Alabama, USA. Any legal claim will be handled in the state or federal courts located in Shelby County, Alabama, unless the law requires otherwise. You may also bring a claim in small claims court if it qualifies.

12. If part of these Terms doesn't apply

If any part of these Terms is found to be unenforceable, the rest still applies.
